1. Service Provider Identification

2. Nature of the Service

AI Code Studio is an intermediary platform connecting users to third-party AI services (OpenAI, Google, Stability AI, RunwayML and others). WE ARE NOT the creators of the AI models.

The service consists of:

• Web interface for accessing third-party AI APIs
• Credit and subscription management
• Temporary storage of generated content
• Organisation and download features

3. Limitation of Liability (CRITICAL)

As an independent worker, Alexandra Hockett provides the Service on an 'as is' basis. Where permitted by applicable law, our aggregate liability for direct damages arising from the Service shall be limited to the greater of: (a) the total amount paid by you to AI Code Studio in the 12 months prior to the event giving rise to liability; or (b) €500.

Note: If you are a consumer, mandatory legal protections under applicable law may override contractual limitations. This clause does not exclude liability for death or personal injury caused by negligence, nor for other liabilities that cannot be limited by law.

4. User Obligations

By using this platform, the user:

⚖️ INDEMNIFICATION: The user agrees to indemnify and hold harmless Alexandra Hockett from any claim, loss or damage resulting from the user's violation of these Terms or misuse of the Service.

5. Prohibited Content and Uses

🚫 STRICTLY PROHIBITED:

• Uploading images of people without their explicit consent
• Creating deepfakes or content intended to impersonate or deceive
• Generating sexual content involving minors
• Violent, sexual, hateful or otherwise illegal content
• Intellectual property infringement
• Using voices of public figures or cloning without authorisation
• Creation of misleading, fraudulent or harmful content

6. AI Labelling, Paid Watermark-Free Plan and Metadata

When publishing or distributing content generated (wholly or partially) by AI, users must clearly identify that content as 'AI Generated' and, when reasonably available, include model attribution (e.g.: 'Generated with DALL·E 3').

For users who purchase a paid plan that allows downloading results without a visible watermark ('Watermark-Free Plan'), you acknowledge and agree that:

• the obligation to disclose that the content was AI generated remains in effect;
• the platform may embed non-visible provenance metadata in the files (EXIF/XMP for images, metadata atoms for videos) indicating the model and content ID;
• the platform will log an audit trail of the purchase, download and your explicit acknowledgement of the labelling obligation;
• failure to externally label the content constitutes a material breach of these Terms and may lead to sanctions, including suspension or termination.

Note: Before launch, we will verify third-party providers' rules regarding watermark removal and attribution.

Important: Each third-party service has its own terms, privacy practices and potential restrictions. We act as an intermediary and are not responsible for changes or suspensions by these services.

8. Applicable Law and Jurisdiction

These Terms are governed by Portuguese law. Any disputes will be resolved in the courts of Portugal. If you are a consumer, mandatory legal protections and consumer jurisdiction rules may apply.
